About these terms

These Terms of Use are between you and Prices with Pinch Pty Ltd (ACN 692 824 463) ("Pinch", "we", "us", "our"). They govern your access to and use of the Pinch mobile application, our website at pinch-app.com, and any related services.

By using Pinch, you agree to be bound by these terms. If you do not agree, please do not use our services.

1. Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms is intended to exclude, restrict, or modify any consumer rights under the Competition and Consumer Act 2010 (Cth), including the consumer guarantees in Schedule 2 (the Australian Consumer Law), or any other applicable Australian consumer protection legislation.

If there is any inconsistency between these terms and the Australian Consumer Law, the Australian Consumer Law prevails to the extent of the inconsistency.

2. Eligibility

By creating an account or using our services, you confirm that you:

• Are at least 15 years of age (or have the consent of a parent or guardian)
• Have the legal capacity to enter into these terms
• Will comply with all applicable laws and regulations
• Will provide accurate and complete information

3. Use of service

Pinch provides a platform to help you compare grocery prices, manage recipes, plan meals, and build shopping lists. You may use our services for personal, non-commercial purposes.

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Pinch app and website in accordance with these terms.

4. User responsibilities

You agree not to:

• Use the service for any unlawful purpose
• Attempt to gain unauthorised access to our systems or other users' accounts
• Interfere with or disrupt the service or its infrastructure
• Upload malicious code, viruses, or harmful content
• Infringe the intellectual property rights of others
• Use automated tools to access the service without our permission
• Impersonate another user or entity

5. User content

You retain ownership of recipes, shopping lists, and other content you create within Pinch. By using our services, you grant us a licence to use, store, and display that content solely for the purpose of providing our services to you.

You are responsible for ensuring you have the right to share any content you upload, including recipes from external sources.

6. Intellectual property

The Pinch app, website, and related content (excluding user-generated content) are owned by Prices with Pinch Pty Ltd and protected by copyright, trademark, and other intellectual property laws.

Our trademarks and trade dress may not be used without our prior written permission.

7. Price information

We track grocery prices across Australian retailers and strive to provide accurate, up-to-date information. However:

• Prices are collected weekly and may not reflect real-time changes or in-store availability
• We track national online pricing and do not capture regional variations, in-store markdowns, or member-only discounts
• Retailers' own terms and conditions apply to all purchases
• We are not responsible for pricing errors or discrepancies between our data and in-store prices

8. Third-party services

Our service may contain links to third-party websites or services, including retailer websites and app stores. We are not responsible for the content, privacy policies, or practices of third-party sites.

9. Disclaimers and limitations of liability

Subject to Section 1 (Australian Consumer Law) above, and to the maximum extent permitted by law:

• Pinch is provided "as is" and "as available"
• We do not warrant that the service will be uninterrupted, error-free, or free of harmful components
• We do not warrant that pricing data will be completely accurate or current at all times

Subject to Section 1, our total liability to you for any claim arising from or related to these terms or your use of the service is limited to the amount you have paid us in the 12 months preceding the claim (or, if you have not paid us anything, $100 AUD).

Subject to Section 1, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of the service.

10. Indemnification

You agree to indemnify and hold harmless Prices with Pinch Pty Ltd from claims, damages, or expenses that arise directly from your breach of these terms or your misuse of the service. This indemnity does not apply to losses caused by our own negligence or breach of these terms.

11. Account termination

You may delete your account at any time through the app or by contacting us. We will delete your personal information in accordance with our Privacy Policy.

We may suspend or terminate your access to the service if you materially breach these terms, after giving you reasonable notice where practicable. In urgent cases (such as security threats or unlawful activity), we may suspend access immediately.

12. Changes to terms

We may modify these terms from time to time. We will give you at least 14 days' notice of material changes by posting the updated terms and updating the "Last updated" date above. Where changes are significant, we will notify you through the app or via email.

Your continued use of the service after the notice period constitutes acceptance of the modified terms. If you do not agree to the changes, you should stop using the service and delete your account.

13. Governing law and jurisdiction

These terms are governed by the laws of New South Wales, Australia. Each party submits to the non-exclusive jurisdiction of the courts of New South Wales and any courts that may hear appeals from those courts.

Nothing in this clause limits your right to bring proceedings in any court of competent jurisdiction, including under the Australian Consumer Law.
